Rules of MIA 76 not prepared for 38 years

PIL for preparing Rules of MIA76

A PIL has been filed in the Aurangabad bench of Bombay High Court with a prayer that WRD may be directed to prepare rules of MIA76 within stipulated time.  Pradeep Purandare, retired Associate Professor, WALMI, Aurangabad has filed the PIL through Ad. Prakash Paranjape. Bench comprising of Hon. Justice Sh. B.P. Dharmadhikari & Hon. Justice Sh. Badar A.M will hear the petition.

The Secretary (Water Resources Planning & Development) and The Secretary (Water Resources Management & Command Area Development) of Water Resources Department (WRD) are the respondents.

MIA 76 is the parent Act of WRD. It has a potential to provide solid foundation & robust framework for water resources development & management in the State. But unfortunately rules of MIA 76 have not been prepared for last 38 years. As such, MIA76 is not in force in the truest sense of the term for all practical purposes. Things become more serious as implementation of River Basin-wise Irrigation Development Corporation Acts 1996-98,  MMISF Act 2005  & MWRRA Act 2005 depends upon implementation of MIA 76. Hence, the prayer - WRD may be directed to prepare rules of MIA76 within stipulated time.

Aurangabad bench of The Bombay High Court has issued notices to all the respondents in this matter on 17 Nov 2014 & has asked them to file their affidavits up to 15 Jan 2015
It may be recalled that Purandare has also recently filed a PIL to operationalise River Basin Agencies, State Water Board & State Water Council to prepare Integrated State Water Plan as per MWRRA Act.
